DHS Reminds Hondurans and Nicaraguans to Re-register for TPS by January 3, 2005 - 12/14/04
According to a DHS Press Release issued December 6, 2004, Honduran and Nicaraguan applicants for TPS must submit both Form I-765 and Form I-821 (with revision date July 30, 2004 or November 5, 2004) to the National Benefit Center, the Chicago lockbox. Photographs are not required upon submission, and no filing fee is required for the I-765 if the applicant does not seek an EAD. Waivers are available for the EAD fee, but not for the biometric fee. $1500 H-1B Fee Now In Effect - 12/08/04
The USCIS website indicates on its forms list that the new $1500 fee is now in effect. Thus, all filings being sent today should include that fee. No reference is made to the $500 fee, signaling that USCIS reads the statute to defer implementation of that fee for 90 days. [ more ]
President Bush, on 12/8/04, signed the FY 2005 omnibus spending package comprising nine appropriations bills. - 12/08/04
The new law contains several immigration-related measures, most notably, reforms to the L-1 and H-1B visa programs. We will post the Public Law number when it becomes available. DHS Publishes Proposed Rule to Raise Fees for Appeals and Motions to Reopen or Reconsider - 12/01/04
The proposed rule will raise fees from $110 to $385, and will apply to fees for appeals and motions relating to the types of cases under the jurisdiction of the AAO. [ more ]
DHS Publishes Proposed Rule to Lift Regulatory Response Times for RFEs and NOIDs - 12/01/04
The proposed rule will remove the fixed regulatory time limitations on responses to Requests for Evidence (RFEs) and Notices of Intent to Deny (NOIDs). Deadlines will be set on a case-by-case basis. The rule is designed to reduce case processing time. [ more ]
