House Passes DOJ Authorization Bill with 2 Objectionable Amendments; VAWA Reauthorization Also Included - 09/30/05
The House of Representatives, on September 28, 2005, passed by a vote of 415-4, the Department of Justice Reauthorization Act for fiscal years 2006-09 (H.R. 3402), which includes the House version of the Violence Against Women Reauthorization Act of 2005. [ more ]
Former Attorney General John Ashcroft Told to Testify in a Suite Involving Muslims Immigrants Held in a Federal Detention center in Brooklyn after 9/11 - 09/30/05
A federal judge in Brooklyn ruled yesterday that former Attorney General John Ashcroft, the director of the Federal Bureau of Investigation and other top government officials will have to answer questions under oath in a lawsuit that accuses them of personally conspiring to violate the rights of Muslim immigrants held in a federal detention center in Brooklyn after 9/11. USCIS Announces Fee Adjustment - 09/27/05
USCIS press release on its revised fee structure for immigration benefits. The new fee structure becomes effective 10/26/05. Note: though it is not reflected in the chart attached, today's Federal Register notice indicates that the I-485 filing fee for children under 14 will go up from $215 to $225. [ more ]

2007 Diversity Visa Lottery Registration Begins - 09/21/05
The Department has announced that registration for the 2007 Diversity Visa (DV) Lottery will begin at noon on October 5, 2005. Persons seeking to enter the lottery program must register online through the designated Internet website during the registration period. Third Circuit Joins First Circuit, Striking Down Regulation Barring Parolees Who Are “Arriving Aliens” From Adjusting While In Removal Proceedings. - 09/20/05
The Court of Appeals for the Third Circuit has ruled that 8 C.F.R. § 245.1(c)(8) is invalid because it "contradicts the clear language and expressed intent" of Congress in INA § 245(a) to allow parolees to adjust status. This regulation bars all arriving aliens - which includes the majority of parolees - from adjusting status if they have been placed in removal proceedings. [ more ]

USCIS Promulgates Fee Increase For AAO Appeals And Motions - 09/14/05
The USCIS published a final rule in the Federal Register announcing a fee increase, from $110 to $385, for the processing of an appeal, motion to reopen, or motion to reconsider, in cases under the jurisdiction of the Administrative Appeals Office (AAO), effective September 28, 2005. [ more ]

H-1B "Lottery" on August 10 Filings - 09/08/05
It appears that USCIS is completing the "lottery" process on selecting those H-1B petitions that were filed on August 10 that will be included in the fiscal 2006 cap. If your case was not selected, you case will be rejected and returned. [ more ]

Court Rules Against Family Firmly Resettled in Canada - 09/08/05
The Ninth Circuit Rules Against Family Firmly Resettled in Canada in Effort to Discourage Forum Shopping. The Court held that a family who abandoned its refugee application in Canada after residing there for 4 years, who enjoyed free health care, public schooling and work authorization, was presumed to be firmly resettled. The Court found that forum shopping undermined the integrity of the international asylum regime. [ more ]
