USCIS (Neufeld) Memo on Conditional Permanent Residents and Naturalization under Section 319(b) - 08/18/09
USCIS memo from Donald Neufeld provides field guidance and updates the Adjudicator's Field Manual (AFM) to address circumstances under which an alien who was admitted as a lawful permanent resident on a conditional basis pursuant to section 216 of the INA may be naturalized under section 319(b) prior to the removal of the conditions. The memo provides that although such CPRs may apply for naturalization, their applications may not be approved until the conditions on their residence have been removed. [ more ]

September 2009 Visa Bulletin - 08/11/09
According to the just released visa bulletin, the EMPLOYMENT FOURTH, AND EMPLOYMENT FOURTH CERTAIN RELIGIOUS WORKER, VISA AVAILABILITY FOR SEPTEMBER: Heavy applicant demand for numbers in the Employment Fourth, and Employment Fourth Certain Religious Worker, categories has resulted in their becoming “Unavailable” for September. This “Unavailable” status will take effect immediately for August because the annual limit for those categories has been reached. Therefore, no further requests for numbers in those categories can be processed during FY-2009. The Employment Fourth preference can be expected to return to a “Current” status for October, the first month of the new fiscal year. The Employment Fourth Certain Religious Workers category is currently scheduled to expire on September 30, 2009, and future availability will depend on legislative action. [ more ]

Board of Immigration Appeals (BIA) To Hear Argument on Matter of Perez Vargas - 08/04/09
On October 1, 2009, the BIA will hear oral argument on whether to vacate Matter of Perez-Vargas, 23 I&N Dec. 829 (BIA 2006), which holds that an immigration judge does not have jurisdiction to determine if a new job satisfies the portability requirements of INA § 204(j). [ more ]

Canada amends "Safe Third" regs for asylum seekers - 08/04/09
On 23 July 2009 the government amended the regulations. Nationals of a country to which Canada has temporarily suspended removals no longer benefit from an exception to the safe third country general rule." CCR, July 24, 2009. Canada has now removed the exception as of July 23, 2009 for nationals of Afghanistan, Burundi, Democratic Republic of Congo, Haiti, Iraq, Liberia, Rwanda, Zimbabwe. [ more ]
