BCIS Announces Latest H1-B Petition Statistics for FY 2003 - 08/29/03
During the first three quarters of FY 2003, the Bureau of Citizenship and Immigration Service (BCIS) approved 56,986 H1-B petitions subject to the numerical cap and 84,534 cap-exempt H1-B petitions. According to BCIS, an additional 47,813 petitions are pending, of which one-third are expected to count against the cap if approved. [ more ]

Service Center Adjudicators May Issue NTAs, the start of a deportation case - 08/29/03
According to the American Immigration Lawyers Association, and based upon a reliable report from a BCIS official that BCIS plans to have adjudicators at the Service Centers start issuing Notices to Appear, possibly as early as October 1, 2003. It is believed that the program will start with TPS applications, and with respect to aggravated felonies, and eventually branch out to all types of filings. Trainings are said to already have been conducted, and a BCIS conference on the subject is planned for the week of September 1. [ more ]

BCIS Headquarters instruct Service Center to exercise discretion on Deadlines Missed Due to Power Outage - 08/29/03
In response to inquiries made by the American Immigration Lawyers Association's (AILA) Service Center Operations Liaison Chair, BCIS Headquarters recently sent a directive to Service Center Directors & Deputies, stating: “Please see concerns from AILA below. Department of State Publishes Instructions for DV-2005 Lottery Registration - 08/28/03
The DOS published its DV-2005 Lottery registration instructions in the Federal Register. Entries must be submitted electronically between Saturday, 11/1/03 and Tuesday, 12/30/03. Applicants may access the electronic Diversity Visa entry form at www.dvlottery.state.gov during the 60-day registration period beginning November 1. Paper entries will not be accepted.(68 FR 51627, 8/27/03). [ more ]

New I-140 and Seven Other New BCIS Forms Required On and After October 1, 2003 - 08/28/03
The BCIS has revised eight forms in recent months for which the newly revised versions will be required on and after October 1, 2003. Those forms include the I-140, I-824, I-129S, I-102, N-470, I-526, I-829, and N-336. [ more ]

The Nebraska Service Center Processing Time Update on Asylee Adjustments - 08/12/03
The Nebraska Service Center, which has sole jurisdiction over asylee adjustments, has advised that they are currently processing asylee adjustment cases filed on or before 11/16/99. Applicants should note that there are exceptions to Iraqi Asylum adjustment applicants. [ more ]

Department Of State Final Rule Creates NIV Classifications for Commuter Students - 08/12/03
The DOS published a final rule creating the two new nonimmigrant visa classifications of F3 and M3 for citizens and residents of Mexico or Canada who seek to commute into the United States for the purpose of attending an approved F or M school. The rule became effective on August 11, 2003.
