USCIS posted supplemental Q & As to its website regarding the 4/4/08 interim final rule extending optional practical training (OPT) for qualified F-1 nonimmigrant students. - 05/29/08
The U.S. Department of Homeland Security released an interim final rule on April 4, 2008, extending the
period of Optional Practical Training (OPT) from 12 to 29 months for qualified F-1 non-immigrant students. The extension is available to F-1 students with a degree in science, technology, engineering, or mathematics (STEM) who are employed by businesses enrolled in the E-Verify program. [ more ]

E-Verify now to utilize data from Naturalized Citizens - 05/20/08
U.S.C.I.S announced that they will begin to implement new information regarding Naturalized Citizens to the E-Verify employment authorization program in hopes that it will reduce the mismatch rate. USCIS hopes that these changes will streamline the effectiveness of E-Verify Notification, and has claimed that these improvements will help to instantly inform employers if their employee is authorized to work in the United States. Are you filing a Notice of Appeal or a Motion with the Immigration office? - 05/20/08
A new version of Form I-290B (Notice of Appeal or Motion) has been added to the USCIS website. According to USCIS.gov, the new form was effective March 4, 2008 and no prior versions of the form are accepted. USCIS has not provided notice regarding the new version of the form. [ more ]

June 2008 Visa Bulletin now available - 05/13/08
The U.S. Department of State (DOS) released the June 2008 Visa Bulletin on May 12, 2008. Visa Dates are announced by the DOS every month. Only applicants who have a priority date earlier than the cut-off date may be allotted a number. Should it become necessary during the monthly allocation process to immediately retrogress a cut-off date, supplemental requests for numbers will be honored only if the priority date falls within the new cut-off date.To view, click on the Proc. USCIS Approves Southeast Los Angeles Regional Center for EB-5 Pilot Program - 05/08/08
A person could invest in a government- designated "regional center", create ten jobs "indirectly" and invest only $500,000. 3,000 of the 10,000 visas are reserved for those who invest in a regional center.
A major advantage of investing in a regional center is that the investor does not have to be involved in the day-to-day operation of the business. It is not even necessary that the investor reside in the same state where the investment is located. [ more ]

USCIS Announces Proposed Rule to Extend Maximum Stay for TN Nonimmigrants - 05/08/08
On May 6, 2008, USCIS announced a Notice of Proposed Rulemaking (NPRM) that would allow TN nonimmigrants to remain in the United States for a maximum of three years before requiring an extension of stay. Additionally, the proposal would allow individuals to request extensions in increments of up to three years, as opposed the current one year. [ more ]

USCIS Update regarding the Child Status Protection Act - 05/08/08
A May 6, 2008, USCIS Update announced the issuance of revised guidance, which modifies the agency's earlier interpretation of the Child Status Protection Act (CSPA) by extending coverage to foreign nationals with an approved visa petition, but without a pending adjustment application on the date of the CSPA's enactment. USCIS Settles Class Action Lawsuit; Certain SSI Beneficiaries Can Request Expedited Green Card & Naturalization Processing - 05/08/08
On May 5, 2008: USCIS settled a class action lawsuit initiated by non-U.S. citizens who had either lost or were about to lose their eligibility for Supplemental Security Income (SSI) due to a seven-year limit and could not become U.S. citizens prior to losing their benefits.

ERROR! Electronic Employment Verification Systems: What Will Happen When Citizens Have To Ask The Government For Permission To Work? - 05/08/08
According to the Immigration Policy Center, many on Capitol Hill are eyeing favorably bills that create a massive electronic employment database. While proponents of the Shuler-Tancredo "SAVE Act" (HR 4088) and the Johnson "New Employee Verification Act of 2008" (HR 5515) talk tough about cracking down on illegal immigrants, the truth is their bills’ nationwide mandatory electronic employment verification system require all American workers, foreign- and native-born alike, to seek the government’s permission to work. If the government database isn’t accurate, Americans will be denied employment and paychecks, at least temporarily, while they attempt to resolve the problem with the government agencies. [ more ]

Department of Homeland Security (DHS) Announces Aviation Security & Travel Screening Changes - 05/01/08
A 4/28/08 DHS press release announced that airlines will be able to systematically verify and store a passenger’s date of birth to clear up watch list misidentifications, enabling more passengers to check in remotely. [ more ]
