USCIS Expands On-Line Filing, Adding Forms I-129, I-131, I-140, I-539, I-821, and I-907 - 05/26/04
U.S. Citizenship and Immigration Services (USCIS) within the Department of Homeland Security announced that it has expanded its electronic filing or E-Filing program. This simple and friendly to use system allows customers to go online to apply for certain immigration benefits. USCIS has added six of the most commonly used immigration applications online, totaling the available applications on the USCIS website to eight forms. Immigration Announces New EAD With Security Features - 05/24/04
USCIS has announced that it will soon start issuing a new Form I-766 Employment Authorization Document that will encompass new security features to help prevent counterfeiting and fraud. Launch is expected in early June 2004. [ more ]
Immigration Sets Process for Matching I-485 Applications with Pending I-130s - 05/24/04
A recent memo from USCIS instructs local offices that where an adjustment applicant has an I-130 pending at a service center, the local office should request the I-130 from the center, which should send it within 15 days. [ more ]
Customs and Border Proctection (CBP) Will Admit Some Journalists under B Status - 05/24/04
Customs and Border Proctection (CBP) announced in a press release that ports may, as a matter of discretion, admit foreign journalists properly admissible in I status under B-2 status, albeit one time only. Department of Labor (DOL) Publishes Notice on Earliest Filing Date for FY 2005 H-2B Labor Certifications - 05/14/04
Department of Labor in a published notice provides that employers may file an H-2B application at least 60 days, but not more than 120 days before the worker is needed. Therefore, employers may begin filing no earlier than June 1, 2004, for a date of need beginning October 1, 2004. [ more ]

USCIS memo provides guidence on ability to pay in Employment based petitions - 05/12/04
The memo directs an I-140 petitioner to submit either: annual report, federal tax returns, or audited financial statement; directs an RFE if I-140 Part 5 is incomplete or for required financials; directs positive determination when net income or assets exceed proffered wage, or where the petitioner is presently paying the beneficiary the proffered wage. USCIS Seeks to Reduce RFEs By Moving Directly to Decision - 05/06/04

USCIS Issues Guidance on Readjudication of Previously Approved Petitions - 05/06/04
According to a recent memo, USCIS provides that prior adjudications should be given deference on extensions and readjudication will only be allowed with specific authorization from the Deputy Center Director where there was a material error, a substantial change in circumstances, or new material information adversely impacting eligibility.
