Federal Appeals Court Rules in Favor of Immigrant Investors - 05/16/03
A federal appeals court has ruled that the Immigration and Naturalization Service (INS) (now the Bureau of Citizenship and Immigration Services) may not apply new rules retroactively to certain immigrant investors. [ more ]
LIFE Legalization Application Deadline is 6/4/03 - 05/16/03
The deadline for LIFE legalization applications is June 4, 2003. The LIFE Act provides eligible applicants with work authorization, and even a stay of removal or deportation proceedings or orders, while their adjustment applications are pending. [ more ]

Updated Report from U.S. Consulate in Juarez, Mexico - 05/07/03
Effective May 2003, Consulate General Ciudad Juarez (CDJ) will consider out-of-district (i.e., Third country Nationals residing in the U.S. only -- TCNs) visa renewal applications providing the initial visa was issued in the applicant's home country, i.e. F1 to F1, H1B to H1B, etc. Applicants who have approved Homeland Security (formerly INS) changes of status while in the U.S. from other categories will be accepted i.e. F1 to H1B. INS/BCIS to cut off all Service Center information numbers - 05/07/03
BCIS has made known that the 800 customer service number will begin accepting inquiries for all the service centers, starting May 12 or 13. Then, approximately two weeks later, it plans to cut off all service center information numbers, other than premium processing, and require that all calls go to the 800 number. Inquiries that require service center response will be forwarded to the applicable service center by the 800 number officer, and it is anticipated that the service center will reply to the inquirer by mail. This move is something that we many are deeply concerned about. [ more ]
BCIS Memo Discusses Waiver of the Joint Filing Requirement Prior to Final Termination of Marriage - 05/07/03
A 4/10/03 memo from the BCIS states that an alien whose conditional resident status is approaching the 2-year anniversary, but who is unable to file a joint petition to remove the conditions because divorce proceedings have commenced, may not apply for a waiver of the joint filing requirement based on the ‘good faith’ exception. DHS Amends Requirements To Obtain Commercial License With Hazardous Materials Endorsement With Immigration Related Provisions - 05/07/03
In an interim rule pusblished in the Federal Register 5/5/03, the FMCSA amends the Federal Motor Carrier Safety Regulations (FMCSRs) to prohibit States from issuing, renewing, transferring or upgrading a commercial driver's license (CDL) with a hazardous materials endorsement unless the Transportation Security Administration (TSA) has first conducted a background records check of the applicant and determined that the applicant does not pose a security risk warranting denial of the hazardous materials endorsement. This interim final rule implements part of the requirements of section 1012 of USA PATRIOT Act of 2001 and certain provisions of the statutes dealing with explosives. [ more ]

TWO U.S. STATE DEPARTMENT EMPLOYEES AND SEVEN OTHERS CHARGED IN SCHEME TO SELL VISAS - 05/03/03
WASHINGTON, D.C.- Assistant Attorney General Michael Chertoff of the Criminal Division and McGregor W. Scott, United States Attorney for the Eastern District of California announced May 1, 2003 that a federal grand jury in Sacramento returned an 18-count indictment charging nine persons, including two former State Department employees, in connection with an alleged corrupt scheme, operating out of the U.S. Embassy in Sri Lanka, to sell entry visas to the United States. > Click here to read the story. Federal Judge in Detroit rules Suspects to stay in U.S. until hearing - 05/03/03
