Immigration and Customs Enforcement (ICE) Plans to Deport All Undocumented by 2012 - 04/29/08
Recent raids by Immigration and Customs Enforcement (ICE) netted hundreds of undocumented immigrants -- the raids are a part of "Operation Endgame," ICE's strategic plan for “removing all removable aliens,” according to immigration experts on Access Washington, a teleconference series offered by New America Media to ethnic media. U.S. Department of State issues May 2008 Visa Bulletin - 04/16/08
The U.S. State Department released the May 2008 Visa Bulletin on April 11, 2008. Visa Dates are announced by the U.S. Department of State every month. We are pleased to see that the EB-3 dates for Philippines, Mexico, and World Categories (except India & China) have moved forward by 8 months. Unfortunately, EB-2 Categories for India and China continue to move at a snail?s pace advancing by only one month. Pursuant to INA � 245(a)(3), aliens with priority dates prior to the cut-off dates shown on the Visa Bulletin will be eligible to file adjustment of status applications during the month of May 2008. USCIS Runs Random Selection Process on H-1B Petitions - 04/16/08
U.S. Citizenship and Immigration Services (USCIS) announced today that they have run the computer-generated random selection processes on both Master?s Cap, and Regular Cap H-1B petitions. The first selection was for 20,000 "master's or higher degree" (advanced degree) exemption. Any remaining advanced degree petitions not selected from the first lottery were then included in the regular cap of 65,000. Petitioners whose properly filed petitions have been selected for full adjudication should receive a receipt notice dated no later than June 2, 2008. Any unselected petitions will be returned along with fee(s) to petitioners or their authorized representatives. In addition, USCIS has determined that they will "wait-list" some H-1B petitions in the case that one of the petitions originally selected is denied, withdrawn, or otherwise found ineligible. USCIS RELEASES PRELIMINARY NUMBER OF FY 2009 H-1B CAP FILINGS - 04/14/08
U.S. Citizenship and Immigration Services (USCIS) today announced a preliminary number of nearly 163,000 H-1B petitions received during the filing period ending on April 7, 2008. More than 31,200 of those petitions were for the advanced degree category. USCIS expects next week it will conduct the computer-generated random selection process, beginning with the selection of the 20,000 petitions under the advanced degree exemption. Those petitions not selected under the advanced degree category will join the random selection process for the cap-subject 65,000 limit. USCIS will reject, and return filing fees for all cap-subject petitions not randomly selected, unless found to be a duplicate. USCIS will handle duplicate filings in accordance with the interim final rule published on March 24, 2008 in the Federal Register. [ more ]

USCIS Q & As: Extension of Optional Practical Training Program for Qualified Students - 04/10/08
USCIS has released Q&As regarding the 4/4/08 interim final rule extending OPT for qualified students. The Q&As also states that the Form I-765 has been amended to require the student to indicate the degree and provide the employer’s E-Verify information. The amended Form I-765 (Rev. 04/08/08) will be required starting May 9, 2008. [ more ]
DHS presses ahead with plan to use Social Security records to enforce immigration laws - 04/10/08
Despite protests from businesses, organized labor, and immigrant-rights groups, the Homeland Security Department is pressing ahead with a controversial rule to use Social Security records to enforce immigration laws. The department's bid, critics say, will harm legal workers and the U.S. economy without solving the problem of illegal immigration because it relies on inaccurate information. The rule, officially published on March 26, amounts to a politically motivated push by Republicans to crack down on employers who hire illegal workers, opponents contend. [ more ]

USCIS REACHES FY 2009 H-1B CAP - 04/09/08
WASHINGTON – U.S. Citizenship and Immigration Services (USCIS) announced today that it has received enough H-1B petitions to meet the congressionally mandated cap for fiscal year 2009. USCIS has also received more than 20,000 H-1B petitions filed on behalf of persons exempt from the cap under the “advanced degree” exemption. [ more ]
