USCIS Instructs District Offices to Correct USCIS-Issued Erroneous I-94s - 04/29/04
In a 3/30/04 memorandum, the USCIS instructs that District Offices shall provide a new, corrected I-94 in cases in which the USCIS is responsible for issuing an I-94 with erroneous information. The USCIS will not correct I-94s issued by CBP, but will direct individuals with erroneous CBP-issued I-94s to go to CBP for corrections. [ more ]

Comprehensive Immigration Reform Bill to be Introduced May 4, 2004 - 04/29/04
On May 4, 2004 Senator Kennedy (D-MA), Representatives Menendez (D-NJ) and Gutierrez (D-IL) and others will introduce a comprehensive immigration reform bill that will include: an earned adjustment for hard-working people residing in the U.S.; "break-the-mold" worker programs; and family backlog reduction. While we have not seen the final bill text, we believe this measure represents a giant step forward, and will help build and sustain pressure for the eventual passage of needed reform in the coming years. Maine Governor Orders Immigration Status Be Kept Confidential - 04/13/04
On April 9, 2004, The Governor of Maine signed an executive order decreeing that state workers not disclose certain information, including immigration status, deemed to be confidential. Former Detroit Immigration Officer Gets Prison - 04/09/04
According to a Detroit Free Press story, Janice Halstead, the former federal immigration officer who was part of a local scheme to illegally sell visas to Arab immigrants, pleaded guilty to charges of conspiracy and bribery in July 200 and was sentenced to 2 years in prison by a federal judge in Detroit on Thursday. USCIS provides Guidence on Adjustment of Status for Asylees - 04/08/04
By law, only 10,000 asylees can adjust status to Lawful Permanent Resident per year; however, USCIS is receiving between 15,700 and 28,200 applications per year. As a result, as of March 1, 2004, approximately 160,000 asylee adjustment applications were pending. At this rate, an application filed on or about Dec. 8, 2003 Oct will be processed on or about Sept. 30, 2015. Please click on more for details. [ more ]

USCIS Provides Naturalization Information for Military Personnel - 04/08/04
If you are a member of the U.S. Armed Forces and are interested in becoming a U.S. citizen, you may be eligible to apply for citizenship under special provisions provided for in the Immigration and Nationality Act (INA). Generally, service in the U.S. Armed Forces means service in one of the following branches: Army, Navy, Marine Corps, Air Force, Coast Guard, Certain Reserve components of the National Guard, and Selected Reserve of the Ready Reserve Recent changes in the relevant sections of the immigration law make it easier for qualified military personnel to become U.S. citizens if they choose to file a naturalization application. In addition, the U.S. Citizenship and Immigration Services (USCIS) has created a streamlined process specifically for military personnel serving in active-duty status or recently discharged. USCIS Changes Asylum Interview Location for Certain Applicants from Ohio, Kentucky, Texas and Louisiana - 04/08/04
Pursuant to a notice published in the Federal Register, Effective 5/3/04, the Houston Asylum Office will no longer circuit ride to Harlingen, Texas, or New Orleans, Louisiana, and the Chicago Asylum Office will no longer circuit ride to Cincinnati, Ohio. New interview locations are provided in the notice. Affected asylum and NACARA§ 203 applicants will be notified of the changes. [ more ]

Department of State Cable Encourages Issuance of H-1B and H-2B Visas with Deferred Validity Dates - 04/08/04
The Department of State cable encourages posts to issue visas with deferred validity dates in order to manage a “possible flood of applicants” for H-1B and H-2B visas for approved FY 2005 employment. Those posts which anticipate a rush of H-1B or H-2B applicants in the lead-up to FY 2005 may issue visas to I-129H beneficiaries prior to September 20, 2004 provided they are annotated as “not valid until ten days prior to petition validity date.” Posts are encouraged to stress to applicants and airline representatives that Department of Homeland Security still prohibits the entry of an alien on an H-1B or H-2B visa more than 10 days prior to employment start-date. The cable also provides a reminder that posts may continue to issue H-1B and H-2B visas for FY 2004 employment against approved I-129 petitions. Click on more to view the cable. [ more ]

DHS to Extend US-VISIT to VWP Travelers by September 30, 2004 - 04/05/04
According to a 4/2/2004 USCIS News Release, DHS will process VWP travelers in US-VISIT, beginning 09/30/04, at all air and sea ports. This expansion of US-VISIT is related to the joint DHS and DOS request to Congress to extend for two years, the 10/26/04 deadline for VWP machine readable passports that include biometrics, and for DHS biometric passport readers to be at all ports of entry. President Bush Continues To Push His Temporary Worker Plan - 04/03/04
