USCIS Announces New Biometrics Process for Conditional Permanent Residents - 03/02/07
On 2/28/07 USCIS announced a new biometrics process for applicants who file Form I-751, Petition to Remove Conditions on Residence, effective immediately. The new process requires all conditional permanent residents to have their biometrics captured electronically at an ASC. See memo below [ more ]

Representatives Berman and Roybal-Allard Announce Introduction of American Dream Act - 03/02/07
On March 1, 2007, Representatives Berman (D-CA) and Roybal-Allard (D-CA), along with Representative Diaz-Balart (R-FL), announced the introduction of the American Dream Act. The Act would provide a path to legal status for qualified students who have lived much of their lives in the U.S. but do not have legal immigration status. [ more ]

USCIS Releases Updated Form I-765, application for employment Authorization - 03/02/07
USCIS revised Form I-765, Application for Employment Authorization, to obtain additional information from National Interest Waiver (NIW) physicians following Schneider v. Chertoff, 450 F.3d 944 (9th Cir. 2006). In its notice, USCIS explains that the form and instructions remove two options as reasons for filing: 1) Replacement of an employment authorization document (EAD) which was never received, and 2) replacement of an EAD with incorrect information caused by USCIS administrative error. USCIS Update: I-130s Filed at Consulates Should Not Be Re-filed - 03/02/07
On February 27, 2007, USCIS released an update on changes to processing of Form I-130. USCIS advised that anyone who filed a Form I-130, Petition for Alien Relative, with a U.S. embassy or consulate since July 2006 does not need to re-file the petition. USCIS is working with the Department of State to process those petitions.

DHS Announces Proposal for Drivers License Compliance with REAL ID - 03/02/07
On March 1, 2007, the Department of Homeland Security announced its proposal to establish minimum standards for state-issued driver's licenses and identification cards in compliance with the REAL ID Act of 2005. click on more to view a copy of the proposal.

FOIA Processing Track Established for Those Appearing Before an Immigration Court - 03/02/07
Effective March 30, 2007, U.S. Citizenship and Immigration Services (USCIS) is improving its processing of Freedom of Information Act (FOIA) requests from the general public by establishing a third processing track for individuals appearing before an immigration court. Currently, a large portion of FOIA requests are submitted by individuals who have received a Notice To Appear for a hearing before an immigration judge or by such individuals' attorneys or representatives. By creating an additional processing track, USCIS states that it will be able to provide the public with more expeditious service and to thereby improve customer satisfaction. [ more ]
