USCIS Guidance on Remaining Classified as Family Second Preference under the CSPA - 03/29/04
A USCIS memo instructs that beneficiaries seeking to retain family 2nd preference classification under the CSPA, due to backlogged priority dates in the first preference category, must submit a written request to the Officer in Charge, who will issue formal written notification of decision on the request. USCIS proposing Increased Validity Period for EADs - 03/25/04
An interim regulation that would allow the USCIS to issue Employment Authorization Documents (EADs) for a period appropriate to the amount of time needed to complete an adjustment of status application, has cleared DHS and has been at OMB since March 4, 2004. OMB generally has 90 days to review a regulation and either reject it or clear it for publication in the Federal Register. If the rule is cleared, it would eliminate the need to file extensions for employment authorization with USCIS. [ more ]

US District Courts Finalize CSS and LULAC (Newman) Legalization Cases - 03/25/04
The United States District Court for the Central District of California approved a final settlement agreement in the CSS and LULAC (Newman) legalization case. In general, the settlement agreement provides a final one-year application period for eligible individuals to file simultaneous applications for class membership and application for legalization on Form I-687. Applications are provided for those who were living in the U.S. in an unlawful status prior to 1982, were eligible for the 1986 legalization program, but who did not apply for certain specified reasons. The application period runs from 5/24/04 to 5/23/05. [ more ]

Dallas District to Launch Adjustment of Status Filing Pilot Program - 03/25/04
The Dallas District of USCIS will launch, on May 3, 2004, a pilot project whereby adjustment of status applications can be filed with an immediate interview and adjudication planned to be completed within 90 days. The appointment system that will underlie this project is expected to be implemented approximately April 13, 2004. The focus of the program appears to be family based adjustment of status. It expressly excludes Asylees, Refugees, Life Act and employment based cases. [ more ]

DHS Interim Rule Eliminates Numerical Cap on Mexican TN Nonimmigrants - 03/15/04
The Department of Homeland Security in a March 10, 2004 interim rule removes the annual numerical cap on the number of Mexican professional admissions under NAFTA. The rule also eliminates the associated requirement of a petition for a Mexican-based NAFTA professional and the corresponding LCA. The rule took effect retroactive to January 1, 2004. [ more ]

DHS & EOIR Issue Proposed Rules Regarding "Safe Third Country" Agreement - 03/15/04
DHS issued a proposed rule on March 8, 2004 that would implement the U.S./Canada "Safe Third Country" agreement which, among other things, provides for a threshold determination to be made as to which country will consider the merits of a prospective asylee's claims. In a similar move, EOIR, on March 8, 2004, issued a proposed rule that would specify the authority of immigration judges with respect to issues arising under the U.S./Canada "Safe Third Country" agreement. Department of State (DOS) Advises on New Procedures for Petitions Returned for Revocation - 03/05/04
Effective immediately, all immigrant, K-1 and K-3 visa petitions being returned with a recommendation to the DHS Bureau of Citizenship and Immigration Services (BCIS) for revocation will be forwarded to the National Visa Center (NVC).
