DHS Launches Traveler Redress Inquiry Program - 02/22/07
On February 21, 2007, DHS announced the launch of the Traveler Redress Inquiry Program (TRIP). Travelers can use the online inquiry program to seek resolution of misidentification issues at ports of entry, or if they have been unfairly delayed or denied boarding for additional screening when traveling.

USCIS CLARIFIES CRITERIA TO EXPEDITE FBI NAME CHECK - 02/22/07

Visa Bulletin for March 2007 - 02/19/07
Department of State released the Visa Bulletin for March 2007, which reflects retrogression in the family-based third preference category for Mexico and the Philippines. Aytes Memo on Adjudication of NIW I-140s for Physicians in MUAs - 02/19/07
This USCIS memorandum dated January 23, 2007 establishes interim procedures for adjudicating national interest waiver (NIW) immigrant petitions and related adjustment of status applications filed on behalf of physicians practicing in medically underserved areas (MUAs) or facilities operated by the Department of Veterans Affairs in light of the Ninth Circuit Court of Appeals decision in Schneider v. Chertoff, 450 F. 3rd 944 (9th Cir. 2006). The memo will be followed by amended regulations to give regulatory effect to the Schneider decision. In addition, although not mandated by the Schneider decision, USCIS is expanding the fields of medical specialty that may qualify physicians for NIWs.

Board of Immigration Appeals (BIA) Addresses Effective Date of Child Status Protection Act - 02/19/07
In a very important decision, the Board of Immigration Appeals held that INA Section 201(f)(1) applies to an individual whose visa petition was approved before the August 6, 2002 effective date of CSPA, but the I-485 was filed after that date. Therefore such individual retains his status as a child. In re Matter of Rodolfo AVILA-PEREZ, 24 I&N Dec. 78 (BIA 2007). [ more ]

USCIS Reveals a New Look for Travel Booklets - 02/15/07
WASHINGTON – U.S. Citizenship and Immigration Services (USCIS) today issued a redesigned travel booklet as part of ongoing security improvements to update agency documents. The fraud resistant identification booklets include digital photographs and signatures and other enhanced security features to deter potential counterfeiting schemes. [ more ]

USCIS Publishes Proposed Rule to Dramatically Hike Fees - 02/01/07
USCIS published a proposed rule to drastically increase fees for immigration and naturalization applications and petitions. In addition to the rule, on January 31, 2007 the Service released a Current v. Proposed Fee Schedule, a Press Release, two Fact Sheets, the transcript of a Message from USCIS Director Gonzalez, and Q & As. See below.

Senate Passes Amendment on Employment of Undocumented Immigrants - 02/01/07
On 1/25/07, the Senate voted 94-0 in favor of an amendment to the minimum wage bill (H.R. 2) that would bar companies employing undocumented immigrants from receiving government contracts. However, the amendment, proposed by Senator Sessions (R-AL), would exempt employers who voluntarily participate in the Basic Pilot program. [ more ]
