05/13/2008 Entry: "June 2008 Visa Bulletin now available"
The U.S. Department of State (DOS) released the June 2008 Visa Bulletin on May 12, 2008. Visa Dates are announced by the DOS every month. Only applicants who have a priority date earlier than the cut-off date may be allotted a number. Should it become necessary during the monthly allocation process to immediately retrogress a cut-off date, supplemental requests for numbers will be honored only if the priority date falls within the new cut-off date.To view, click on the Proc. Times and then Visa Bulletin.
Progress of just a few months can be seen in the EB-2 Categories for China and India however no advancements have been seen in the EB-3 category. What is the cause? Demand for numbers, primarily by Citizenship and Immigration Services Offices for adjustment of status cases, will be expected to bring the EB-3 category very close to the annual numerical limit in June. The visa bulletin reports that nearly 90% of employment numbers have been issued. As a result, this category is most likely to experience retrogressions or visa unavailability beginning in July. Such action would only be temporary, and the bulletin services state a complete recovery of the cut-off dates would occur for October, the first month of the new fiscal year. What does that mean? It means that visa numbers could retrogress or even become unavailable in the June/July/August/September visa bulletins. Make sure to stop by our website for the latest updates and information on the DOS Visa Bulletins. Pursuant to INA § 245(a)(3), aliens with priority dates prior to the cut-off dates shown on the Visa Bulletin will be eligible to file adjustment of status applications during the month of June 2008.
