Ashcroft, No. 02-73363 (9th Cir. Oct. 21, 2004), the court said that predicating a waiver on the summary disqualification of an entire law firm violated the statutory right to counsel of choice. The court also said that the notion of banning an entire law firm from representing a Petitioner, without providing either the attorney or the petitioner a hearing or opportunity to be heard on the exclusion, was extraordinary.
