03/15/2004 Entry: "DHS & EOIR Issue Proposed Rules Regarding "Safe Third Country" Agreement"

DHS issued a proposed rule on March 8, 2004 that would implement the U.S./Canada "Safe Third Country" agreement which, among other things, provides for a threshold determination to be made as to which country will consider the merits of a prospective asylee's claims. In a similar move, EOIR, on March 8, 2004, issued a proposed rule that would specify the authority of immigration judges with respect to issues arising under the U.S./Canada "Safe Third Country" agreement.
